Terms and Conditions

These are the terms and conditions of Avenger Gold Coast Fishing Charters. Please read them and if you have any queries do not hesitate to contact us at info@avengerfishing.com.au.

BOOKING & REFUND POLICY

A 50% deposit is required to secure a booking and no tentative bookings will be accepted

Full payment is required 24 hours prior to departure for all booked seats. Any outstanding balances are due for payment 24 hours before the charter leaves.

Bookings can be rescheduled provided the request is made 14 days prior to the booking.

Gift Voucher numbers must be given at the time of booking otherwise they will not be accepted.

Gift Vouchers expire 3 years from date of issue and cannot be extended

Gift Vouchers are not redeemable for cash or refundable under any circumstances. If your charter is cancelled due to weather, you can reschedule to another date.

Refunds can only be obtained from an Agent when aspects of the Safety and Weather policy apply and only after they have sought confirmation and authorisation from Avenger Fishing Charters. (Refunds do not apply to gift cards).

Off-shore trips are pending on weather conditions. If inclement weather conditions prevail, it is up to the Skipper’s discretion as to whether the trip will proceed. You may nominate a full refund of deposit or transfer your deposit to an alternative date if your trip has been cancelled due to weather.

If a person becomes unwell and requests to be returned back to shore, then no refund will be given and it is also up to the Skipper’s discretion whether or not to return to port.

All trips are refundable if we (Avenger Gold Coast Fishing Charters) cancel or reschedule the trip. (Refunds do not apply to gift cards).

All charters are subject to minimum (6) and maximum (12) numbers of passengers*

Any fishing rods, reels or equipment that are lost overboard or damaged in any way due to customer negligence must be paid for by the customer before leaving the boat

Avenger Gold Coast Fishing Charters will not be held liable for any indirect costs incurred by booking a fishing charter with us. 

In the event the trip is cancelled at any time by Avenger Gold Coast Fishing Charters, we will not be held liable for any travel costs, meals, accommodation or any other costs the customer may have incurred.

These terms and conditions apply to all bookings either directly with us or booked through an Agent * Special note: Our vessel is surveyed for 12 passengers, please contact us directly to request for charter with up to 12 passengers

 

CANCELLATION POLICY

More than 7 days prior to booking:

Any cancellations or changes requested with a minimum of 7 days’ notice are eligible for a full refund, credit or to reschedule. No fees apply. (Refunds in these circumstances do not apply to gift cards).

Less than 7 days day prior to booking or ‘no shows’:

If a cancellation is made less than 7 days prior to a booking, or the customer does not attend on the day (‘no show’), the customer will not be eligible for a refund or credit and gift cards will be redeemed/cancelled. Any outstanding monies will be charged in full.

Cancellation Communication:
Cancellations must be made directly with Avenger Gold Coast Fishing Charters, by phone (0487 369 515) or email (info@avengerfishing.com.au). The customer is responsible for ensuring the cancellation has been received and responded to by Avenger Gold Coast Fishing Charters.

Minimum Operating Numbers Cancellations:
Avenger’s Gold Coast Fishing Charters have a minimum operating number of 6 passengers. In the rare event the minimum has not been met, a cancellation email will be sent, and the customer will have the choice to reschedule or receive a refund and/or gift cards to be made valid again. (Refunds do not apply to gift cards).

 

GIFT CARDS

Gift cards are non-refundable for cash or refundable under any circumstance.

If the customer is eligible for a rescheduled charter and has booked using a gift card/s, the associated gift card/s will be un-redeemed and remain valid until the original expiry date.

If the customer is not eligible for a reschedule, associated gift card/s will be redeemed/cancelled.

If a charter is cancelled by Avenger Fishing Charters due to weather, the gift cards will be made valid again until the original expiry date.

 

CUSTOMER BEHAVIOUR

It is required that all customers behave in a safe and respectful manner to all staff, other customers and our property.

If we find that there has been loss or damage to our equipment or vessel due to negligence or unruly behaviour then the customer will be liable for replacement or repair of the item (funds will be taken from the credit card that is held for security).

The Skipper reserves the right to cancel a trip and payment forfeited if unruly or unsafe behaviour is displayed.

 

SAFETY AND WEATHER POLICY

Charters are not affected by rain, but strong winds and big swells may result in cancellation of a charter

Marine weather forecasts can change during the day and overnight. We will endeavour to inform you via text or phone and email if any decision to cancel a charter is made. Please ensure your phone is switched on.

In an instance where the weather may turn unexpectedly it is at the discretion of the Skipper as to whether any, a full, or part refund is given.

Children under the age of 16 must be accompanied by an adult and become their responsibility whilst on board the boat.

All customers must declare any pre-existing medical conditions or any medication prior to departure (as some people may require special attention).

We have the right to ask any customer to wear a life jacket at any time.

Only wine and beer (in cans) are permitted to be taken and consumed on the boat in moderation. The skipper has the authority to ban drinking alcohol at any time to enable a safe boating situation to be maintained for all on board. If you breach this policy and an early return to shore results from unruly behaviour you will be liable for compensation to the other passengers on the boat. Private charters will not be entitled to any refund. Anyone who turns up to attend a charter inebriated or under the influence of drugs will not be allowed to board.

WAIVER (applies to all guests boarding our vessels)

Customers boarding our vessel confirm that they (and their guests) are aware that they are boarding a charter fishing vessel to fish in open offshore waters and possibly in sites that are difficult for rescue vessels to reach, making it difficult for rescue, medical assistance, or other assistance.

Customers assert that they and their guests are physically fit to fish and ride on the vessel and will not hold OZDIVE Pty Ltd Trading As Avenger Gold Coast Fishing Charters or their employees, agents or other associated personnel responsible if they or their guests are injured as a result of ANY problems (medical accidental or otherwise) which occur while fishing, riding on the vessel or otherwise participating in the trip.

Customers and their guests understand and assume the risks and hazards associated with offshore fishing. These risks and hazards include, but are not limited to, the following:

Sun, rain, lightening, water spray, and other weather conditions, motion sickness, pitching and rolling, slippery and wet decks and surfaces.

Injuries (internal and external) from: boarding and disembarking the vessel, fish, fishing, fishing tackle and gear, adverse sea weather conditions and the conduct of any other persons on the boat.

In consideration of being accepted to participate in this fishing trip, customers and their guests hereby personally assume all risks and hazards of the activity, whether foreseen or not, that may befall them while they are a participant.

Customers and their guests understand and agree that neither OZDIVE Pty Ltd Trading As Avenger Gold Coast Fishing Charters, nor their employees, agents or other associated personnel responsible may be held liable or responsible to the customer (and their guests) to their family, or estate in any way for any injury, death or other loss or damage tthem that may occur as a result of them participation in this fishing activity or as a result of the negligence of any person, including the released parties and other passengers on the vessel, whether passive or active.

Customers and their guests RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE any of the released parties in respect of anything arising from the fishing activity or any related rescue operations.
